Novelist Kakwenza Rukirabashaija has vowed to take the law in his hands after withdrawing his case against the Ugandan state. As a way of revenge, Kakwenza now threatens his tormentors’ wives and children.
Kakwenz has filed an application, withdrawing his case from the East African Court of Justice (EACJ). He had been accusing the Government of Uganda of torturing and abusing him during arrest at different occasions: in April and September 2020 as well as in December 2021.
“The Applicant hereby wholly withdraws and/or discontinues the above-described Reference, without leave, in accordance with Rule 61(1)(a) of the East African Court of Justice Rules of Procedure, 2019,” Kakwenza notified the EACJ.
According to the summary of the case filed in February 2022 in the EACJ, Kakwenza accused SFC of breaking into his house and for frowning upon lawful court orders.
“The Applicant alleges that the Respondent through his agents the military Special Forces Command (SFC) ON 28th December 2021 broke into the Applicant’s house without a warrant; SFC confiscated the Applicant’s phone illegally searched and did not return it after 72 hours; arrested the Applicant without a warrant and detained him for two weeks beyond mandatory 48 hours…” read the summary in part.
It added that the state had “ignored Chief Magistrate Court order for mandatory release of the Applicant; ignored an order for release by the court to produce the Applicant, charged the Applicant in absence of the Applicant’s lawyers, therefore, violating the constitution of The Republic of Uganda which violates the Articles 6, 7and 8 of The Treaty for the Establishment of East African Community.”
As Kakwenza now threatens his tormentors’ wives and children, he has complained of the court’s failure to handle his case, arguing that by doing nothing about his case, they had denied him justice by delaying it.
Kakwenza says he will use all means at his disposal to revenge. He claimed to know his tormentors’ residences and their family members.
“Justice delayed is justice denied. I’ll personally revenge using all means possible. I know where my tormentors live and their children and wives,” he wrote. “Time to take matters into my hands—revenge.”
Kakwenza fled Uganda in 2022 following claims that he was tortured by security officers. Kakwenza alleged that the security officers forced him to undress so that they could laugh at his ‘big cassava.’ Kakwenza also alleged that he had eaten transport money from Museveni’s agents and refused to see him.
