
The election of Luyimbazi Nalukoola as Kawempe North MP has been nullified and a fresh election ordered. As court throws Nalukoola out of parliament, a new election is now expected.
The ruling by Justice Bernard Namanya of the High Court was delivered after weeks of hearings on the petition filed by Faridah Nambi of President Yoweri Museveni’s ruling National Resistance Movement (NRM) challenging Nalukoola’s election victory.

“… in accordance with Section 80, 82 (4) (c) and 82 (6) (C) of the Parliamentary Elections Act (Cap 177), I order as follows,” declared Namanya.
“That the election of Luyimbazi Elias Nalukoola as a Directly Elected Member of Parliament for Kawempe Division North in Kampala District is set aside.”
Namanya further ruled “that the seat for the Directly Elected Member of Parliament for Kawempe Division North in Kampala District is declared vacant.”
The judge then said “that the Electoral Commission is ordered to conduct a fresh election for the Directly Elected Member of Parliament for Kawempe Division North in Kampala District.”
Nalukoola of the main opposition National Unity Platform replaced fallen MP Muhammad Ssegirinya who passed on after battling sickness.
Nalukoola was sworn in last month after Justice Simon Byabakama Mugenyi, the Chairperson of the Electoral Commission (EC), gazetted the results of the Kawempe North byelection.
Before the gazetting of the victory, the opposition had voiced concerns on the delays by the Electoral Commission to publish the notice of declaration of results, on which the speaker swears in a new member.
Now, Nalukoola has to get into another election if his appeal against the ruling does not succeed.
