“Pursuant to Articles 145, 7 and 151 (b) and 2 of the Constitution, and Standing Orders 78 (8) of the Senate, the Senate has removed from office by impeachment Rigathi Gachagua, the Deputy President of the Republic of Kenya. Accordingly, Rigathi Gachagua ceases to hold office.” This was the declaration that Senate Speaker Amason Kingi made about half an hour before close of Thursday, October 17, 2024, confirming the Rigathi Gachagua impeachment after a vote by Kenyan Senators.
But that was after the Kenyans Senators voted on 11 counts which were the grounds for Rigathi Gachagua impeachment. Overall, the senators voted agreed to impeach Gachagua on five on the 11 grounds.
For count one relating to the gross violation of Articles 147 and 152 of the Constitution of the Republic of Kenya, 54 senators were in support as 13 were against.
For ground two on gross violation of Articles 147 and 152 of the Constitution, 28 Senators voted in favour while 39 were against impeaching the deputy president on this ground.
On count three relating to gross violation of Articles 6, 10, 74, 186 and 189 of the Constitution on undermining devolution, 45 senators were against impeachment while 18 were in favour.
The fourth ground was gross violation of Article 160 of the Constitution and related to undermining the institutional and decisional independence of the Judiciary. On this 51 Senators voted for impeachment as 16 voted against it.
Count number five was gross violation of Articles 3 and 148 of the Constitution and related to the breach of oath of office and allegiance. For this, 49 Senators voted to impeach Rigathi Gachagua while 16 voted against as two abstained.
For ground number six on crimes under Sections 13 (1) (a) and 62 of the National Cohesion and Integration Act, up to 48 Senators were in support, 18 voted against while one abstained.
Ground seven on crimes under Sections 45 (1), 46, 47a (3), and 48 (1) of the Anti-Corruption and Economic Crimes Act and Sections 2, 3, 4, and 7 of the Proceeds of Crime and Anti-Money Laundering Act failed as 52 senators voted against it, with only 14 supporting it and one abstaining.
Ground number eight was on crimes under Section 132 of the Penal Code and Section 29 of the Leadership and Integrity Act, which also failed with 40 senators voting against it and 27 supporting it.
The ninth count was on gross misconduct relating to public attacks on the National Intelligence Service and its officers. This ground succeeded with support from 46 Senators while 20 opposed as one abstained.
For count number ten on gross misconduct relating to insubordination, 45 senators voted against as 22 supported it.
The 11th count on gross misconduct relating to bullying failed as 47 voted against it, 18 supported it while two abstained. Read more on Rigathi Gachagua impeachment Here.
